Tax Credit Key to Market in 1st Quarter 2010

This important incentive is helping to stabilize the housing market in communities all across the country. Extending and expanding the home buyer tax credit will enable even more families to take advantage of current low interest rates and affordable prices to invest in their future through homeownership

As part of its plan to stimulate the U.S. housing market and address the economic challenges facing our nation, Congress passed new legislation late in 2009 that:

Extends the First-Time Home Buyer Tax Credit up to $8,000 to first-time home buyers until April 30, • 2010.

Expands the credit to grant up to $6,500 credit to current home owners purchasing a new or existing • home between November 7, 2009 and April 30, 2010.

Who Qualifies for the Extended Credit?

First-time home buyers who purchase homes between November 7, 2009 and April 30, 2010.•

Current home owners purchasing a home between November 7, 2009 and April 30, 2010, who have used • the home being sold or vacated as a principal residence for five consecutive years within the last eight.

How is a Buyer's Credit Amount Determined?

The price of the home. •

The buyer's income. •

Can a Buyer Still Qualify If He/She Closes After April 30, 2010?

Under the Extended Home Buyer Tax Credit, as long as a written binding contract to purchase is in effect • on April 30, 2010, the purchaser will have until July 1, 2010 to close.

Will the Tax Credit Need to Be Repaid?

No. The buyer does not need to repay the tax credit, if he/she occupies the home for three years or • more. However, if the property is sold during this three-year period, the full amount credit will be recouped on the sale.

What Forms are Needed to Apply for the Tax Credit?

The IRS has released IR-2010-006 providing a revised Form 5405 to reflect the changes to the tax credit • made in the extension and expansion legislation enacted in November 2009. The release reminds taxpayers that all tax returns claiming the tax credit must be filed manually (i.e., they cannot utilize the IRS E-File automatic system). The revised form includes a section for those repeat buyers who are eligible to claim the $6500 tax credit. The HUD-1 or evidence of the transaction must be filed with all returns claiming the credit (both the $8000 and $6500 credits). Individuals who claim the repeat buyer credit must also provide evidence that they have owned and used the prior residence for 5 consecutive years. The instructions indicate that property tax or homeowners insurance records are sufficient for this purpose.

New Lending Policies Announced by FHA - Sell or Buy by April 5th before the changes take place.

 

If you were listening to the housing news last week, you probably heard a number of reports about lending changes that were announced by the Federal Housing Administration (FHA). While many of the news reports were confusing, the truth is pretty clear, and isn't as bad as some people may have heard.

Overall the measures are intended to help the FHA better manage its risks and strengthen its capital reserves, while still providing home loans to the nation. The good news, as FHA Commissioner David Stevens stated recently, is that "by continuing to provide affordable, responsible mortgage products, FHA will support the housing market's recovery" and "remain the largest source of home purchase financing for underserved communities."

What's Changing?

If you or someone you know is considering an FHA loan, some of these changes may affect you. Here's a clear, concise rundown of the major changes and what they mean:

1. Increased mortgage insurance. The mortgage insurance premium (referred to as private mortgage insurance by many people) will be increased from 1.75% to 2.25%. This change will add some cost to purchasing a home, but will not overburden consumers since the mortgage insurance is paid over the life of the loan, rather than upfront at closing.

2. New down payment and credit score requirements. According to the new policy, homebuyers who have a credit score of at least 580 may still be able to purchase a home with 3.5% down, but those with credit scores of less than 580 will be required to put down at least 10%. This change is designed to help the FHA balance its risk, while still providing affordable down payments for consumers with a history of good credit and responsibility.

3. Reduced seller concession. Basically, this change means that the person selling the home will now only be able to offer the homebuyer 3% to help defray closing costs, as opposed to 6% under the previous policy.

In addition to these changes, the new policies contain a series of new measures aimed at increasing lender enforcement.

These changes will become effective on April 5, 2010. The bottom line is that the changes will impact some homebuyers more than others. But in the end, the FHA is still committed to providing affordable home loans.

Staging Your Home For Success

Staging homes is not only a passion of mine, but I have learned the dynamics of how it truly impacts a buyer during the home selection process. Buying a home is a very emotional process and often, buyers are so focused on their budget and bottom line, they are unable to “imagine” what a home “could” be. In addition, if a home is dirty or cluttered, a buyer will actually focus on that rather than looking at the home. That is why staging is so important. It allows the buyer to quickly see the space and appreciate its possibilities. Home staging is an exciting way to create a beautiful, warm environment that can be enjoyed by all.

Is Staging Expensive? It does not have to be! There are many things that you can do to freshen up your home that are inexpensive. Whether you are staging your home to sell, opening your home to friends or you desire an instant face-lift, home staging is an easy and affordable design option that can be done room-by-room.

Always start at the Front Door/Front Yard! This is the first place that your Buyer will see and first impressions are lasting impressions! Usually my buyer is standing behind me, scanning the front of the home while I am unlocking the door. This usually takes about 45 seconds and it completely sets the tone for the first impression.

Here are 10 inexpensive ways to grab the attention of your potential buyer at the Front Door:

1.       Mow the lawn and trim the edges regularly. Prune any bushes or tress that block the view out of your windows. Pull weeds, freshen mulch in flower beds and add a splash of seasonal color.

2.       Remove garden art and accessories from flower beds to give a clean look.

3.       Power wash the entry and sidewalks. Remove any wasp nests. So many buyers are terrified of wasps and will begin judging the moment they see a nest. There is a feeling that they will always have to run from them to avoid getting stung.

4.       Replace the worn doormat. Pick out something simple but elegant. Stay away from doormats that mention animals, have hints of sarcasm. Stick to plain and simple “Welcome”.

5.       Upgrade your outdoor lighting. You may be amazed of how inexpensive this upgrade is and the return on investment well worth it. Check Home Depot and Lowes… they often carry 2 packs of coach lighting for less than $40. Stick with Black, Brushed Nickel or Oil Rubbed Bronze finishes. Regardless of the sale, stay away from shiny finishes like Brass.

6.       Repaint or Replace your House Numbers. Make them “pop” and look fresh.

7.       If you do not have a custom mailbox, freshen up the old one with paint or install a new one.

8.       Install or polish your door hardware.

9.       Add a wreath for a splash of door color and to welcome your potential buyer.

10.   Park your cars away from the front of your house or driveway.

Winding Down a Busy Week - by Buyers Agent - Angela Owens

It is Sunday morning and I am winding down from a busy week. Buyers are really motivated now and eager to get into a home. I have written multiple offers this week for buyers seeking a home, not a steal. There are several factors influencing the sudden surge of buyers. Of course the tax credit available to new buyers and move up buyers is a huge influence. Keep in mind that in order to qualify, a buyer needs to have the contract buttoned up by the end of April. In addition, many buyers are filing their tax returns and planning to use refunds to help with the move, down payments, new furnishings, etc. The great weather this week has helped, as well! As a Buyer’s Agent, I urge any Seller that is on the fence about listing their home to stop waiting. Get your home ready and get it listed. Real Estate Market is picking up.

1.       Raise Upfront Mortgage Insurance Premium from 1.75% to 2.25%.  In 2008, the UFMIP was raised to 1.75% from 1.50%.

2.       Riskier borrowers will be required to make larger down payments – increase from present 3.50% (previously 3.0%) to 10% down payment.  There is currently a bill in Congress to raise the minimum down payment from 3.50% to 5.0%.

3.       An option to the 5.0% down payment proposal is to reduce Seller contributions from 6.0% to 3.0%.

The Federal Housing Administration will announce more-stringent lending requirements and higher borrower fees on Wednesday to cushion against rising defaults and stave off the need for a taxpayer bailout of the agency.

The FHA, which has taken on a major role in the housing market during the economic downturn, doesn't lend money to home buyers, but insures lenders against default on loans that meet FHA criteria. In exchange for that backing, borrowers who take out FHA-backed loans must pay an upfront insurance premium, currently set at 1.75% of the total loan amount. The premium can be rolled into the loan.

The FHA is set to raise that fee to 2.25%, the second increase in the past two years, according to people familiar with the matter. The value of the FHA's reserves to cover losses has fallen to $3.6 billion, about 0.5% of the $685 billion in loans outstanding, down from 3% a year earlier. Congress requires the agency to maintain a 2% capital-reserve ratio. If the larger upfront fee had been in place last year, the FHA would have boosted its reserves by more than $1 billion.

Also to boost the reserve, the FHA will ask Congress to increase a separate insurance fee that borrowers pay annually, people said. If the agency were to run short of cash to cover projected losses, it likely would have to ask Congress for money for the first time ever.

FHA officials declined to comment.

The FHA, which backs as many as half of all new loans in certain housing markets, has come under fire for insuring loans with little or no money down as home prices have plunged over the past three years. With its reserves falling, the agency has been forced to walk a tightrope between protecting taxpayer dollars and helping to facilitate the housing recovery.

The FHA will keep minimum down payments at the current 3.5% level for most borrowers. But the agency will require riskier borrowers with credit scores below 580 to make a minimum 10% down payment. While the FHA doesn't have a credit-score cutoff, most lenders require a minimum 620 score.


Some housing analysts have pushed for higher down payments on FHA-backed loans, and a bill in Congress would raise down payments to 5%, from the current 3.5%.

Instead, the FHA will reduce the amount of money that sellers can kick in for closing costs to 3% of the sale price, down from the current level of 6%. The higher cap led to abuses where sellers "heavily marked up the purchase price," says Lou Barnes, a mortgage banker in Boulder, Colo.

The FHA is also set to announce a series of measures to boost its ability to oversee and take action against lenders that originate loans with FHA backing.

"Mortgage lenders will find the new rules painful but necessary," says Howard Glaser, an industry consultant. He says the rules were overdue given that "an 'anything goes' environment" had prevailed in recent years as former subprime brokers migrated into FHA-backed loans
